During the battles over the election procedures in the state of Arizona, the Democratic National Committee had challenged the state of Arizona’s policy prohibiting ballot harvesting and Arizona’s requirement that in-person voters cast their vote at their designated precincts. 19-1257 Brnovich v. Democratic National Committee (07/01/2021)
On July 6, 2021, however, the U.S. Supreme Court concluded that these measures are important in ensuring a fair and accurate election and that Arizona did not violate the Voting Rights Act by enforcing them.
During the litigation battle, non-partisan Election Integrity Project California (EIPCa) and Election Integrity Project Arizona (EIPAz), together with attorney Mike O’Neil of Landmark Legal Foundation filed an influential friend of the court brief informing the Court of the dangers of ballot harvesting.
EIPCa still strongly supports the U.S. Supreme Court’s ruling that ballot harvesting measures do not ensure fair and accurate elections and that the state of Arizona did not violate the Voting Rights Act by enforcing such laws prohibiting ballot harvesting.
However, in recent weeks, several high profile political proclamations have been made to persuade the public that ballot harvesting is the only way to win at the game of elections in the new millennium. Based upon the careful study of ballot harvesting, the Coalition for a Principled Republic (CPR) stands with EIPCa and the ruling of the United States Supreme Court. Ballot Harvesting undermines fair, honest, and transparent elections.

EIPCa still persists today. Here are the latest articles posted regarding the nefarious realities of the elections (or the appearance of elections) in the state of California (whiuch may be occuring in other states across the US).
If You Can’t Beat ‘Em, Don’t Join ‘Em; Change the Game
The results of last November’s election were surprising to many, and certainly unanticipated given the history of American election trends and the economic situation at the time.
The response of the disappointed has been predictable: a vow to adopt the winning side’s election strategy, and do it better. Surely that will produce the long-desired win.
Since the November 2022 election, many with high positions in both major political parties, even those who had been staunch believers in voting in person on Election Day, have now joined the band wagon and are all in for voting early, voting by mail and ballot harvesting. But EIPCa knows that encouraging early voting and ballot harvesting will not wiproduce the hoped-for equality of opportunity for all candidates as long as election manipulation made possible by porous election laws goes unchecked.
After twelve years of observation, research, and documentation to support our stance, EIPCa believes that the game should be to harvest VOTERS, not ballots. And those voters need to cast their votes in-person, on the last day of voting, so the turnout and probable trending results are unknown to the manipulators ahead of time.
Here’s why: When any ballot comes in early, that fact is public information. Anyone who wants to know whose ballot is in, where they live, and what their political party is just has to look.
The manipulators know instantly how the vote totals are trending
with plenty of time to inject the proper counter ballots into the system.
So, you can harvest as many legitimate ballots as you want, but you will continue to lose because you are tipping your hand, playing poker with your cards facing your opponent, giving them all the information they need to manipulate the outcome by just enough to win.
The goal of energetic, hopeful but naïve people and groups is to push voting early is to: 1) increase the number of votes reported in order to intimidate their opponents with high numbers; 2) make sure no voters “forget” to vote; and 3) economize on Get Out the Vote and volunteer efforts expenditures.
These are well thought-out and reasonable justifications, but the policy plays right into the hands of their opponents.
The easy way is seldom the wisest way.
The manipulators have the upper hand. They push early voting to facilitate their behind-the-scenes ballot and election manipulation through strategically injecting ballots from phantom voters and other illegitimate sources to turn the tide.
A random and uncontrolled injection of ballots without knowing exactly how many were needed would be obvious and the penalty flags would fly. That’s why the manipulators need voters to vote early to provide them the information they need to tweak the results “just enough” to look credible.
When their opponents join enthusiastically into the game, they become the pawns ripe for sacrifice.
We saw in Arizona how in-person voters were “encouraged” to change their voting methodology for the future. The manipulators were ready for the challenge of a large influx of in-person voters on Election Day: 1) misprinted ballots, 2) scarcity of ballots, 3) malfunctioning machines and other irregularities that produced long lines and caused many to abandon their efforts to vote.
In doing so, they were forced to show their hand through obvious voter suppression. They exposed their tactics, brought their manipulation out of the shadows. And Americans will not allow that to happen for long, regardless of the reluctance of the courts to do the right thing.
Those who truly believe in fair, honest and transparent elections must not sink to the level of their opponents but rather stand firm, assert their voting rights, and work unceasingly to change the rules of the game so that the election process cannot be manipulated.
EIPCa’s lawsuit is designed to be a mortal blow to the existing “rules” by proving the unconstitutionality of them all.
Until then, California voters still have the right to CHOOSE to
Vote in person on, or as close to the last day as possible;
educate everyone we can as to why they should do the same; and
get ACTIVE by harvesting VOTERS, not ballots.
Yes, that takes more time and energy, knocking on doors, creating car and van pools, physically getting out the vote. A BIG job.
But if voters hold firm and elect and hold accountable officials who will change the rules of the game to restore integrity to the election process, the tools being used by the manipulators can be taken away. Game over. The winners?

Do You Know What You Don’t Know?
Each election, ballots are now mailed to the last known address of every name on the “active” voter rolls. (To find out why “active” does not mean what it appears to mean, please read EIPCa’s article on voter roll maintenance, linked HERE.)
Each election, the majority of those ballots are marked and then sent in using U.S. mail, drop boxes or harvesters.
Problem:
All of those ballots are now completely outside the chain of custody.
Because those ballots are marked outside the supervision of elections officials, there is no way to determine if the legitimate voter is the one who marked the ballot, or if the voter was bullied, rewarded or threatened into marking it a certain way.
Due to California law and regulations, the only tool that can be used to make sure each ballot came from a legitimate voter is signature comparison. (Calif. Election Code Regulation #3019. Scroll down)
These signature verification laws and regulationsare so loose that it is almost impossible to follow them and still question or reject
even the most obvious of non-comparable signatures.
As long as ballots are mailed to all voters and voters are allowed to return their marked ballots by mail, drop box or harvester, it is possible to manipulate the outcome of an election anywhere along the way. For example:
· Divert blank ballots to manipulators before they reach the intended voter; the manipulators then cast them. Because of the loose signature verification regulations, most if not all will be accepted and counted.
· Divert ballots that cannot be delivered as addressed so they are not returned to the elections office but instead wind up in the hands of manipulators.
· Dump marked ballots from certain populations on the way to the elections office into dumpsters, ditches, landfills, bushes, etc. so they never arrive and get counted.
o Every election season there are news headlines with stories, pictures and videos of large numbers of ballots found in dumpsters, in ditches, in the bushes, etc., put there by handlers for various reasons, none of them acceptable.
· Pay or coerce postal workers to “bend the rules”.
. Reported in the news many times: whistle-blowing U.S. Postal Service employees admitting they were ordered to backdate postmarks to so that ballots that entered the system too late to be legally counted could still be accepted.
· Bully, threaten or pay voters to mark their ballot in a certain way.
· Harvest ballots from naïve and trusting voters, and alter or “lose” those that will not advance the cause of the harvesting persons or organizations.
· Vandalize selected drop boxes so the ballots within are destroyed.
· Accept or reject signatures selectively.
The list of manipulation possibilities is, of course, much longer, but those above refer directly to what can happen when blank ballots are universally mailed out and allowed to be returned in the ways listed above.
Mailing a ballot to any individual without a recent verification of eligibility, correct residence or even existence is a reckless threat to election integrity and to the health of the Republic.
Hundreds of thousands of ballots are returned undeliverable each election because of the permanent vote by mail program and now the universal mailing statute.
And that is just the tip of the iceberg. Hundreds of thousands more go “unaccounted for”. Where are those ballots?
· Some may have been thrown away by the owner, who chose not to vote.
· Some may never have reached the owner, having been destroyed or waylaid.
· Worst of all, some may account for the “phantom ballots”—the ballots cast and counted even though they cannot be connected to any voters.
In 2020, EIPCa’s data team reported 124,000 more votes were cast and counted than the number of voters who voted.
How much money is spent on paper, printing and two-way mailing of this volume of misdirected, unused, and misused ballots?
· There is no way to determine how many more ballots were “lost” and used fraudulently because of the broken chain of custody.
The vote by mail system is a destroyer
of election integrity. It is the enemy of a
fair, honest and transparent election process.
A return to mandatory in-person voting (with the tightly controlled absentee ballot alternative for qualifying individuals) would
1. eliminate millions of dollars of mandatory ballot printing and mailing costs,
2. return chain of custody,
3. allow CA to produce timely election results and
4. restore not only CA’s reputation in the nation but also popular faith in the election process, which is currently at an all-time low.
Let us speak the capital “T” Truth. As long as there is any voting by mail outside of the 1 to 3% of individuals who have no other choice, there will be no election integrity.
Enough of the early voting, vote by mail, ballot harvesting nightmare. We the People can restore election integrity if we come together and demand it.
We need to stop shrugging our shoulders and saying,
“What can we do?”
We need to stop saying, “It is what it is.”
NO! - “It is what we allow it to be.”
What will you allow?
